Judicial review of toddlers’ mobility benefits

A court ruling has granted a judicial review of mobility benefits for children under three years of age. Stephen and Wendy Meek, whose son Justin can’t walk and is oxygen dependent, argued in court that the non-payment of mobility benefits to under threes contravened their son’s human rights. Now the Court of Session has ruled that the Department of Work and Pensions (DWP) may have breached Justin’s rights under European law.

UK charity Contact a Family and the Every Disabled Child Matters (EDCM) campaign, who have campaigned on this issue, have welcomed the ruling which could force the DWP to review its current position.
